Man accused of stabbing 6 year old to death waives right to hearing
UTICA, N.Y. (WKTV) - The attorney for the 30-year-old Sherrill man accused of stabbing his girlfriend's six-year-old daughter to death has waived his right to a hearing to try and suppress statements and admissions he made to police.
David Trebilcock is accused of stabbing six-year-old Lauren Belius to death in the Sherrill home he shared with the child and her mother in July.
On Thursday in Oneida County Court in Utica, Trebilcock's attorney, Assistant Oneida County Public Defender Patrick Marthage, waived his client's right to a Huntley, or, suppression hearing, regarding seven statements and admissions Trebilcock allegedly made to police at St. Elizabeth Medical Center and on the way to the hospital.
Due to a gag order issued by Oneida County Court Judge Michael Dwyer prohibiting the attorneys from talking to the media, Marthage could not confirm whether he is not challenging the statements because they strengthen a possible insanity defense.
The next step in this case - the prosecution must file a medical report with the court on December 22.
