Man appeals sentence after admitting to killing his son


FLOYD, N.Y. - An appeal began, Wednesday, for a father, who just two 3 years ago, was sentenced for killing his son.

Back in June of 2010, Adam Theall admitted to placing his infant son over the barrel of a shotgun and pulling the trigger, injuring his own hand in the process.

In spite of his guilty plea, Theall is now attempting to appeal the case, claiming the judge didn't adequately explain the intoxication defense.

The case is being argued today in the appellate division in Rochester. There should be a decision regarding the appeal in about a month.

Theall is currently set to spend the next 25 years to life in state prison.
