Man charged with attempted murder in August accused of choking girlfriend

AVA, N.Y. (WKTV) - The Ava man charged with attempted murder over the summer is facing new charges after he had a domestic dispute with his girlfriend early Sunday morning.

According to the Oneida County Sheriff's Office, 35-year-old Albert Nellenbach of Webster Hill Road allegedly chocked his girlfriend, LeAnn Evans, in the presence of their two young children.

When police responded Sunday morning, Nellenbach had left the residence.

Sheriff's deputies, New York State Troopers, and New York State DEC searched the area and Nellenbach was eventually located and taken into custody.

Following Sunday's incident, Nellenbach is charged with two counts of endangering the welfare of a child and criminal obstruction of breathing. He was sent to the Oneida County Jail with no bail.

In August, Nellenbach allegedly shot 31-year-old Jesse Wilcox on his property. In November, he pleaded guilty to a charge of assault instead.

Because it was an assault charge, Nellenbach was out of jail awaiting sentencing.
