Federally boarded inmate accused of attacking man who pleaded guilty to Marcy arson

ORISKANY, N.Y. (WKTV) - Authorities say that a man who recently pleaded guilty to setting fire at a local apartment complex had been assaulted in jail by another inmate just days before.

According to the Oneida County Sheriff's Office, James T. Kirk, 39, was involved in a January 2 altercation with Yasmeen Fagan, 36, of Syracuse - a boarded federal prisoner at the Oneida County Correctional Facility. Authorities say the altercation began over shower shoes. During the altercation, Fagan reportedly struck Kirk with a blind side punch to the right eye area.

Kirk then followed Fagan to Fagan's cell where Kirk was struck several times in the face and head, causing multiple contusions and abrasions, authorities said.

Kirk was treated in the jail medical area and moved to another housing area.

Fagan has been charged with second-degree assault and will appear in Whitestown Court at a later date.

This was just days before Kirk pleaded guilty on January 6 to arson. Kirk admitted setting fire to the Willows at Chaminade apartment complex in Marcy in October 2011. At the time of the guilty plea, Kirk's attorney said Kirk was despondent over a variety of things in his life: a failed relationship, piling bills and said that his pain kept him from seeing the damage of his action.
