Man who shot three-month old son in front of police indicted by grand jury

UTICA, N.Y. (WKTV) - The man who shot and killed his three-month old son one month ago in front of a State Trooper has been indicted by an Oneida County Grand Jury.

Adam Theall, 21, has been charged with one felony count of second-degree murder.

Authorities witnessed Theall shoot his three-month old son, Eithen Theall on June 22 outside his parents home in Blossvale. 911 calls had alerted authorities that he was making threats against the child and said that he would kill the infant if police arrived. When they responded to the scene, Theall instantly killed baby Eithen and then turned the gun on police. Authorities said they ordered Theall to drop his weapon, which he refused, causing them to immediately open fire.

Theall suffered roughly 14-16 wounds, and was transported to the hospital.

On the night of Saturday, June 26, 2010, a wheelchair-bound Theall was wheeled by State Police into a Town of Floyd Courtroom where he pleaded not-guilty to the second-degree murder charge.

Theall is expected to be arraigned in Oneida County Court sometime next week, but attorneys were not able to confirm an exact date Thursday evening.
