No criminal charges in SU student's Thruway death

GERMAN FLATTS, N.Y. (WKTV/AP) - A grand jury declined to file charges against a driver who killed a 21-year-old Syracuse University student as she tried to cross the Thruway in a snowstorm last February.

Jeff Carpenter, an assistant Herkimer County district attorney, says the panel declined to indict 48-year-old Edward MacKenzie of Ilion. McKenzie's attorney has said his client didn't know he had hit a person. He turned himself in after seeing media accounts of the accident.

His car struck Jamie Klemczak of suburban Albany, whose car had slid off the Thruway near German Flatts and got stuck in the snow as she was making her way home around 4:30 a.m. She was struck as she walked across the opposite lane.
