State Supreme Court Judge to challenge current Herkimer County Judge


HERKIMER COUNTY, N.Y. (WKTV) - An interesting, somewhat unexpected battle for the bench is shaping up in Herkimer County.

State Supreme Court Judge Michael Daley has decided he is running....for County Court. Daley's state term expires in 2015 and he can run for County Court without stepping down.

Daley says it's not the approximately $15,000 decrease in salary that makes the county post so attractive, but rather, the idea of returning to his first love - criminal law.

"It is what I'd rather be doing," Judge Daley said. "There are some people who think Supreme Court is something that is higher than County Court. I don't view it in those terms. Job satisfaction to me is far more important than a title. I would much prefer to be back in the criminal aspect of the law."

Herkimer County Court Judge Patrick Kirk says he will run for re-election.

Daley says he's prepared to primary Kirk if necessary. If Daley wins the county seat, that would open up his state seat in Herkimer County.
