Utica man accused of assaulting wife

(WKTV) - A Utica man faces several charges after he allegedly assaulted a woman, Utica police said.

Erving Gary, 32, of Oneida Street, is charged with criminal contempt, two counts of criminal mischief, harassment and criminal possession of a controlled substance.

According to authorities, on Saturday, Gary allegedly came to his wife's home -- where he does not reside -- and began to argue with her. Gary is accused of breaking her phone when she attempted to call 911. According to the woman, Gary grabbed her by the arms and threw her into a wall. The wife had a city court order of protection against Gary.

Gary was arrested on Sunday. When he was arrested, he is accused of possessing a glass cylinder smoking device with crack cocaine residue inside.

The woman suffered a shoulder injury during the incident. Once medical documentation is received, more charges may be pending.
