Utica man arrested for 2011 murder on James Street

UTICA, N.Y. (WKTV) - Utica police say they have arrested 31 year old Octavius Garrett of Watson Place on a grand jury indictment for murder in the 2nd degree.

Police say Garrett was charged for his role in the May 25, 2001 homicide of 24 year old Anthony Garner on James Street near West Street.

Earlier this year on on March 15th, 31 year old Marshall Jackson of Utica was sentenced to 25 years to life in prison after a trial jury found him guilty of second-degree murder, weapon possession and possessing a stolen gun for his role in the shooting death of Garner.

Jackson was arrested immediately after the shooting because he ran in the direction of police officers who had heard the shots from around the corner and were approaching the area.

The shooting was captured on surveillance video from a convenience store on James Street.

It showed three men involved in the shooting of Garner.

Police say Octavius Garrett is one of the two men involved in the shooting of garner and they say is seen in the video fleeing the area after the shooting.

No word yet on whether police are close to arresting a third suspect.
