Woman accused of animal abuse appears in court

(WKTV) - A Herkimer County woman accused of animal abuse appeared in court on Tuesday, while lawyers from both sides argued about where the 12 dogs should live while the case winds through the court system.

New York State Police seized the dogs from Barbara Smith's home on State Route 28 between Herkimer and Middleville. Smith's attorney says that her dogs should be returned to her and that they were like family.

The opposing side says the dogs should stay at the Herkimer County Humane Society until the trial is over because they are considered evidence. The judge is expected to make a decision within a few weeks.

Smith's trial is set for April 7.
