(WKTV) - A Utica woman is charged with driving while intoxicated and police say she violated Leandra's Law.

Annmarie Rathbun, 33, of Noyes Street, is charged with two misdemeanor counts of DWI, a misdemeanor count of aggravated DWI and a misdemeanor count of aggravated unlicensed operation of a motor vehicle.

According to police, a UPD officer was patrolling Park Avenue around 10:30 p.m. Sunday when he saw a traffic violation. After stopping the car, he became concerned about the driver's sobriety. After an investigation, he determined the driver had a blood alcohol content of 0.17, which is almost twice the legal limit. In violation of Leandra's Law, there was a 9-year-old in the car.
