City still refuses to talk about its responsibilities in James Street inspection

UTICA, N.Y. (WKTV) - Still no answers as local families hold funeral services Friday for loved ones killed in the James Street fire.

City of Utica officials continue to avoid answering the question of who was responsible for enforcing a judge's order against James Street landlord Timothy Klotz.

NEWSChannel 2 left messages once again Friday with the Corporation Counsel for the City of Utica, which are the city's attorneys. But once again, there was no call back.

Friday morning, we talked to local attorney Leon Koziol, who was Corporation Counsel for the City of Utica under the Hanna Administration.

"As a former Corporation Counsel for the City of Utica under Mayor Hanna, do you have any belief as to why we're not getting calls back from the current corporation counsel?" Reporter Gary Liberatore asked.

"I would only speculate," Koziol responded. "But I assume they bear the lions share of responsibility here. They clearly did not follow up on the orders of the court and the court does have the power to take it to the next level...for non compliance. But somewhere in the communication system within city hall, somewhere internally, an official dropped the ball, and I think it's a serious matter."

The City of Utica cited the owner of the building Timothy Klotz for not registering the apartment building on James Street back in 2008.

Klotz was fined $100 and ordered by a city court judge to register the building within 10 days, so that the city could inspect the building.

Klotz never registered, so the city could not go into the building and inspect it. The question remains, what did the city do to follow up on the judge's ruling?

City Court Judge John Balzano said earlier in the week that once sentencing was over in this case, it was out of the court's hands.

The judge said if something was returned to the court by the city that Klotz didn't comply, the court could have issued an arrest warrant for him.

So far, we have not received a response from the city about their follow-up.
