Cueball beating death trial continues: No one would take victim to hospital

UTICA - Kevin Stolarcyk and Bradley Stanistreet are being tried at the same time for the death last summer of Carl Hill.

Several witnesses took the stand today; some talked about a rivalry between Rome and Westmoreland that lead to the fatal fight.

Today, a childhood friend of defendant Bradley Stanistreet took the stand and said that before they went to the house party in question on August 11, he saw Stanistreet come out of a shed or barn at his home with a white sock, and that Cory Adam - a person who's already pleaded guilty in this case - put a billiard ball, a black 8-ball, in the sock.

Among the most damaging testimony today from 17-year-old William Creaser was that one of the men, either Cory Adam or Bradley Stanistreet, said, 'That could probably kill somebody."

The witness couldn't recall which man said this. This witness also talked about seeing defendant Kevin Stolarcyk attacking Carl Hill while Hill lay on the ground.

"I remember Kevin Stolarcyk going up to him and kicking him," said Creaser. "Kick him in his body and his head."

Carl Hill's girlfriend just gave birth to the couple's second child - a boy named Carl - in December. She cried quietly today during lots of tough testimony. Witnesses said Carl Hill vomited after being severely beaten; that he curled up on the ground trying to defend himself, and that when he lay, beaten and unconscious, no one would take him to the hospital.

Also today - a female witness whom reporters were prohibited from photographing talked about seeing both defendants hit Carl Hill with a billiard ball in a sock.

When there would be an inconsistency between her testimony today and her statement to police after the incident, she kept referring to a second statement she gave police.

The defense asked to have the charges dismissed because they weren't given any second statement.

The judge denied that request, directing the prosecution to find out if indeed a second statement existed in writing. If it does, the judge said the defense can re-call that female witness and question her again.
