UTICA, N.Y. (WKTV) - A judge has agreed to examine statements the Frankfort woman accused of stabbing her estranged husband allegedly made to police after the crime.

Jenise Haddad Smith is accused of stabbing Todd Smith at his parents' Westmoreland home back in March. She faces attempted murder and assault charges. Her attorney says it was self-defense and that the couple has a history of domestic violence. He has concerns about the conditions under which some of her alleged statements to police were made.

"The fact that the principle statement was given when she was in the hospital and in intensive care, so, we'll kind of take a look at those, see what the background is and exactly what her condition was when she was interviewed," says attorney George Aney.

Haddad Smith's suppression hearing is scheduled for October 1 in Oneida County Court.
