Rape conviction from 2007 upheld by State Appellate Division

HERKIMER, N.Y. (WKTV) - The 2007 rape conviction of a man for an incident in the Town of Schuyler has been upheld by the State Supreme Court.

The Supreme Court of the State of New York Appellate Division Fourth Judicial Department unanimously affirmed the conviction of Gregory Harvey of first-degree rape, third-degree rape and second-degree unlawful imprisonment.

Harvey was found guilty by a trial verdict in Herkimer County Court on May 23, 2007 from an incident that occurred on March 13, 2006 in the Town of Schuyler, according to Herkimer County District Attorney Jeff Carpenter.

Harvey is serving a 20 year sentence with five years post-release supervision as a result of his conviction.

Assistant District Attorney Jacquelyn M. Asnoe presented oral arguments on October 22, 2012 on behalf of the People of the State of New York.
