My fiance and I own and operate a small Dog Rescue in Upstate NY (Brandy Keg Kennels), where we rescue dogs of all breeds from high kill shelters in the South as well as locally, and give them a second chance at life by finding them forever homes. Over a year and a half ago, we purchased a classic motorcycle from my fiance's brother, in order to customize it and auction it off at a local Pet Expo to benefit our Rescued Boys and Girls. The profits for this could have easily paid for the large quantities of quality dog food we use every day, as well as for necessary vet. care. After listening to 18+ months of excuses as to why he couldn't give us the bike even after he cashed our check (he was moving to a new house, he misplaced the title, etc.), he just informed us this week that he never had any intention of giving us the bike, and that he is not returning the money either because he never gave us a receipt... So, we advised him that we are retaining an attorney and proceeding to court. He then began making threats against our rescue as well as our family, including our two young sons (his nephews), and he advised us that if we attempted to pursue this matter, he would do everything in his power to ruin us, including calling Child Protective Services with false allegations that they rescued dogs pose a danger to our sons. His wife informed us that within 2 weeks "your boys will be calling me Mama, because I have friends in CPS". We have received the promised visit from CPS with no issues, as expected, and he and his wife have continued driving slowly by our home and rescue in an attempt to intimidate us into giving in on this matter. We have had to file for restraining orders to keep our sons and the rescued dogs under our care safe from harm because of this. There is even an event set up on Facebook to try to help encourage him to just do the right thing and give us what we paid for, so that we can continue to provide the level of care that our Rescued Boys and Girls deserve without bankrupting our family. We are at a loss as to what else to do resolve this situation. We are hoping that if enough people voice their opinions of his actions against his own family and a struggling charity organization, whatever remaining conscience he has will prevail. Thank you for your support.

DID YOU ATLEAST WRITE IN THE MEMO LINE OF THE CHECK WHAT THE MONEY WAS FOR? THAT MAKES IT BINDING TO HIM - SINCE HE CASHED THE CHECK, SIGNING HIS NAME TO IT IN AGREEMENT!

Thank you, and yes, we are in the process of obtaining copies of the endorsed check from our bank. We have retained an attorney too, so that should help.

you paid with a check? then you have proof, your bank can help you obtain the necessary documents showing that the check made out to him was cashed and the money deducted from your account
