UTICA, N.Y. -- Dave Gordon accused the Oneida County executive of having an affair with a former staffer in his county office, and now a lawsuit is pending.
Caitlin McCann is suing David Gordon over the accusations.
Gordon is challenging Anthony Picente in a Republican primary.
He claims he has evidence that an affair took place, and that McCann had Picente's baby.
McCann's attorneys are giving Gordon until Thursday to retract his accusations or face legal action.
Gordon released a statement saying:
"Caitlin McCann has retained Anthony Picente's good friend Louis T. Brindisi who has been representing criminals of organized crime for nearly 6 decades. Why would we expect anything different. In fact, the Brindisi Law firm has made several donations to the Picente campaign the most recent reported in January of this year. Today, Brindisi who was previously arrested on drug charges, among other things was hired by the Picente administration to tackle the very same thing he was arrested for...oh the irony. As it is my belief that McCann and Picente engaged in this affair while she was an employee of Oneida County, acting in a public capacity she is held to a much higher standard than your regular everyday Jill. Not only does Mr. Brindisi's involvement call into question his role in all of this, given that his son is our local congressman, it is also my opinion that he is obstructing justice from occurring for the people of Oneida County. Furthermore, this is all an act of desperation by the Picente campaign. There will never be a lawsuit by McCann because during discovery and deposition, she'd have to tell the truth. This includes Picente, the sheriffs that witnessed the affair and even Mrs. Picente who knows all about her husband's deceitful trail of lies."
