Herkimer County Family Court Judge Candidates are reacting to found ballots from the towns of Norway and Salisbury.

Herkimer County Family Court Judge Candidates, Thad Luke and Mark Rose, are reacting to found ballots from the towns of Norway and Salisbury.

On Friday, the Herkimer County Board of Elections found 31 uncounted ballots for the Family Court Judge race.

“It's human error, I’m sure that’s all it is, I don’t think there’s any kind of misgivings going on in the office, we’re all human we all make mistakes," Sylvia Rowan, Herkimer County Republican Committee Chair, said.

After the ballots were counted, Luke was unofficially declared the winner by five votes.

“The Board of Elections has a process, and the process found the missed ballots and they had the fortitude to come forward and say to both candidates, we made a mistake, and here’s the ballots and they called us in to count them," Luke said. “I certainly believe it was an honest mistake, there’s no one in that election office who’s trying to fix this election.”

Rose says he is not blaming the Board of Elections for making a mistake, but he is questioning the process.

“We’re always going to have human error and we should expect human error and accept human error," Rose said. "I think the process itself is very, very flawed here, I think we see it and the process has to be examined.”

According to the republican commissioner, there will be no recount. For that to happen, Rowan says one of the candidates would have to take legal action.

Rose says it's something he is considering.
“It's my understanding that a lawsuit would have to be brought, I don’t want to have to bring a lawsuit, but the question is whether I should do that for my voters, they need to know," Rose said. “I would like to see a recount and audit but not brought on by a law suit, I would like to see the county legislature or the Board of Elections take it upon themselves to do this.”
