UTICA, N.Y. (UPDATED) -- An Oneida County Court Judge has ruled that Brandon Clark will not get a trial.
Clark is accused of the murder of 17-year-old Bianca Devins, on Boilermaker Sunday of last year. He pleaded guilty on Feb. 10, of this year.
On Oct. 14, the Hon. Michael L. Dwyer held a hearing to allow attorneys for both sides to present oral arguments.
The judge has denied the Clark's motion to withdraw his plea of guilty on the grounds that it wasn't entered freely, knowingly and voluntarily and because he was denied his right to effecive counsel.
In his decision, the judge points out the times when Clark was told his decision to plead was final. He also pointed out that Clark had earlier expressed satisfaction with his legal representation and had freely admitted, during his plea allocution, that he committed the murder.
Next, Clark will be sentenced for his guilty plea to the murder of Bianca Devins. His next court appearance is scheduled for Nov. 10.
