Details released from first trooper on scene of Deerfield fatal shooting

A copy of the deposition written by the first New York state trooper on scene at Tuesday's fatal shooting in Deerfield has been released.

UTICA, N.Y. - A copy of the deposition written by the first New York state trooper on scene at Tuesday's fatal shooting in Deerfield has been released.

A homeowner, Ronald Stolarczyk, 64, shot and killed the two alleged intruders, Patricia Anne Talerico, 57, and Nicholas Talerico, 27. State police say the pair was attempting to burglarize the man's house. 

Stolarczyk was arrested and charged with criminal possession of a weapon because the gun he used in the shooting was his deceased father's. It was never re-registered to him. 

State Trooper Michael Hennessy said in a statement the following:

"I arrived at the residence and observed a male subject with a beard, wearing a brown flannel shirt and dark colored pants at the edge of the driveway holding a gun in his right hand and he was on the phone. I asked the male subject to drop the gun and he placed the gun on a wooden post at the end of the driveway. I asked the male subject if he was the caller and he stated yes. I took possession of the gun which was a silver revolver and secured it in my vehicle. I then approached the subject who stated that he shot someone in the garage and the other one ran south on Walker Road. I then placed the subject in my vehicle and made my way to the residence. I looked in the garage door and observed what appeared to be a female lying on the floor just inside the entry door. She was wearing a neon yellow reflective jacket with black leggings. I checked the female and she was unresponsive, so I called for EMS to respond. An emergency medical technician from Deerfield Fire Department arrived and pronounced her deceased. I secured the scene until additional units arrived."

The homeowner is being held at the Oneida County Jail pending his court appearance in Deerfield Town Court. 

The investigation into the incident is still ongoing.
