UTICA, N.Y. – Oneida County has filed an appeal after a judge denied the county’s motion to dismiss a lawsuit concerning the Nexus Center project in Utica.
Heuber-Breuer Construction is suing Oneida County and the Upper Mohawk Valley Memorial Auditorium Authority for $10 million, after claiming the entities breached their contract by misrepresenting the funds available to support the project.
The company claims the county said there was a $49 million fund to pay for the project, which didn’t exist at the time the company signed the contract. The company is seeking $10 million for unpaid work completed on the project.
Two of the construction company’s initial motions were dismissed in November, but an amended complaint was filed in December. On Feb. 23, the county’s motion to dismiss the new complaint was denied. They filed an appeal of that decision on Feb. 25
Construction work on the Nexus Center stopped in May of 2020.
