KIRKLAND, N.Y. – A Clinton man has been indicted on the felony charge of aggravated vehicular homicide, after authorities say he was involved in a fatal crash while driving with a blood alcohol level of .18%.
The accident happened on Dec. 22, 2019, around 7 p.m. in the town of Kirkland.
Police say Richard J. Burdick Jr., 56, was driving northbound down State Route 12B, with three passengers in his pickup truck, when he crashed into another vehicle.
The driver of the other vehicle, 66-year-old David Pearsall, died at the scene. His passenger, Lorie Pearsall, was taken to the hospital to be treated for minor injuries.
Burdick and his three passengers, Kelly Gell, 44; Lawrence Gell, 57; and Quinton Gell, 23, were also treated for minor injuries.
Burdick was arrested by the sheriff’s office warrants unit.
