UTICA - A trial date has been set for the man accused of killing his brother after a fight in their home this past summer.
38-year-old John Ferguson appeared in Oneida County Court Tuesday morning and waived a suppression hearing. He had previously rejected a plea offer last month. Judge Michael Dwyer will says he review a search warrant to determine if evidence collected at the scene can be used at trial.

The trial date has been set for January 28, 2019.
Ferguson is charged with second-degree murder and third-degree criminal possession of a weapon in connection to the death of 41-year-old Daryl Ferguson. The brothers lived together in a home in Yorkville with their mother. John Ferguson is accused of stabbing his brother to death during an argument early in the morning of July 17.
A second-degree murder conviction carries a minimum sentence of 15 years to life in prison, and a maximum sentence of 25 years to life.
